Your privacy is important, so here at List App, Inc., we’ve put together this privacy policy (“Privacy Policy”) to let you know what information we collect when you use li.st (the “App”) and any related websites, software, mobile apps, and other services that we provide (together, the “Service”), why we collect it, and how it is used. This Privacy Policy is governed by our Terms of Use. By using the Service, you agree to the data practices described in this Privacy Policy.

1. The Information We Collect

When you register for the Service, we may collect the following personal information about you: name, email address, profile picture, password, and personal URL. We may also automatically receive and record information about your use of the Service, including IP address or mobile device ID, cookie or web beacon information, and pages requested. You can choose not to provide us with some information, but doing so may limit the functionality or your ability to use the Service. When you post lists on the App, like or comment on other lists, or otherwise interact with users and the public on the App, we will keep records of those posts interacts.

With your permission, we may also collect information about you from your Facebook and Twitter profiles, as well as information from your mobile device (such as contacts) and the friends you invite to use the Service.

If we combine or associate information from other sources with personal information that we collect through the Service, we will treat the combined information as personal information.

2. How We Use the Information

We use your information to operate, maintain, enhance, and provide the features of the Service. We may also use it to provide other services and information that you request, to respond to comments or questions and otherwise support users. Additionally, we may use your information to understand and analyze usage trends on the Services, combat scam and fraud on the Service, understand your preferences in order to provide you customized content, such as advertisements, improve the Service, and develop new products, services, features, and functionalities.

3. How We Share Your Information

When you post your lists, comment on lists, and otherwise interact with other users of the Service, your comments and materials will be visible to the public, so please be sure that everything you post you are willing to show to the whole world.

We do not rent, sell, or share personal information we collect about you to or with third parties. We do share your information with our third party service providers, such as analytics service providers and our data hosting partners. With your permission, we will also share your personal information with third parties such as Facebook and Twitter in connection with your use of the Service.

We may also disclose your personal information if we are required by law or if we believe that doing so is necessary to (i) comply with law or legal process, (ii) protect or defend the rights or property of List App, Inc., or (iii) take urgent action to protect personal safety of users of the App, the Service, or the public. If ever we go bankrupt or are acquired by another company, we may transfer the information you provide us to a third party or share your personal information with a company that acquires us.

4. Your Choices

You can choose to make your account on the Service a “private’ account, which means that only users approved by you can view your lists and the lists you post will only be seen by your followers and cannot be shared on Facebook or Twitter. If you elect to have a private account, the privacy features will protect all of your lists, not just some of them, but remember that your comments on other user’s lists and other interactions with other users will still be visible to the world.

5. Security of Your Information

We use industry standard security practices to protect your information, such as automatic database back-ups, local storage of works-in-progress, and encryption of APIs and accounts. Despite our use of reasonable measures to protect the security of your information, no security measures will always be 100% effective, and List App, Inc. will not be responsible if third parties circumvent our security measures or otherwise access your information without authorization.

6. International Transfers

Personal information that we collect on the Service is stored and processed in the United States or other country in which we may maintain facilities or service providers. When you use the Service, you are agreeing to the transfer of your information outside of your country.

7. Third Party Sites

While using the Service, you may find links to other websites, products, or services that we do not own or operate (“Third Party Sites”), including those that you can view while on the Service through a WebView Module or inset browser. We do not control Third Party Sites and, if you visit them, please know that our Privacy Policy does not apply to them. We are not responsible for the privacy practices of Third Party Sites and encourage you to read their applicable policies.

8. No Children Allowed

Children under 13 years old are not allowed to use the Service, and we do not knowingly collect personal information from children under 13 years old. If we learn that we have collected personal information from a child under 13 years of age, we will delete that information as quickly as possible. If you believe that we may have collected personal information from a child under 13, please notify us at support@li.st.

9. Notice to California Residents

The California Civil Code requires us to tell you that we do not share your personal information with third parties for their direct marketing purposes.

10. Updates

We may update this Privacy Policy in the future, so please review this Privacy Policy frequently and stay informed about any changes we make to this Privacy Policy. We will post any updates to our Privacy Policy and the updated version will be effective when we post it.

We may, in the future, want to use personal information for uses not previously disclosed in our Privacy Policy. If our practices change regarding previously collected personal information in a way that would be materially less restrictive than the version of our Privacy Policy under which we collected the information, we will use reasonable efforts to provide you notice and obtain your consent to the new uses (as required by law).
